1. Acceptance of Terms

Age Requirements

MingleTrivia is rated 9+ on the Apple App Store. By using the Service, you represent that you are at least 9 years of age. Users under the age of 13 may only use the Service with the express consent and active supervision of a parent or legal guardian. The parent or guardian must agree to these Terms on the minor's behalf and accepts full responsibility for the minor's use of the Service.

If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms and consents to your use of the Service. We reserve the right to terminate access if we have reason to believe a user does not meet applicable age requirements.

Agreement to Terms

By accessing or using MingleTrivia — including by creating an account, joining a waitlist, purchasing content, or simply launching the app — you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.

Changes to Your Agreement

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. See Section 14 for our notice procedures for material changes.

2. Our Service

What MingleTrivia Provides

MingleTrivia is a social AR trivia game for iOS that transforms any in-person gathering into an interactive multiplayer experience. Our Service includes:

• AR Face Card Trivia Games: Using ARKit face tracking technology, MingleTrivia displays trivia questions as augmented reality face cards — visual overlays anchored to players' faces via Face ID hardware.
• Peer-to-Peer Multiplayer: Real-time multiplayer gameplay is powered by Apple's MultipeerConnectivity framework, enabling device-to-device communication over Bluetooth and local Wi-Fi without requiring an internet connection during play.
• AI-Powered Trivia Pack Generation: Users may use AI credits to generate custom trivia packs on any topic using our AI generation service.
• Document-to-Trivia Conversion: Pro subscribers may upload PDF or DOCX documents, which our AI processes to generate trivia questions based on the document's content. Uploaded documents are deleted from our servers after processing is complete.
• Curated Trivia Pack Library: A growing library of 15+ professionally curated trivia packs spanning general knowledge, pop culture, seasonal themes, and more.

Independent Product

MingleTrivia is an independent product. We are not affiliated with, endorsed by, or connected to any educational institution, school district, university, or other organization. Any resemblance to other products or services is coincidental. Use of MingleTrivia in educational settings is at the discretion of the relevant institution and educator.

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be unavailable due to scheduled maintenance, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable.

Beta and Preview Features

Certain features may be released in beta or preview form. Beta features are provided "as is" and may be modified or discontinued without notice. Your use of beta features is at your own risk.

3. Account Registration

Current Status: Waitlist

Full account registration is a future feature. Currently, users may join our waitlist at mingletrivia.com. By joining the waitlist, you provide your name and email address so we can notify you when the Service launches. Waitlist registration is subject to our Privacy Policy.

Future Account Requirements

When account registration becomes available, the following requirements will apply:

• Accurate Information: You must provide accurate, complete, and current information during registration and keep your account information updated. Providing false or misleading information is grounds for account termination.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@mingletrivia.com if you suspect unauthorized access to your account.
• One Account Per Person: Each person may maintain only one account. Creating duplicate or multiple accounts is prohibited. Accounts are personal and non-transferable.
• No Impersonation: You may not create an account using another person's name, email address, or identity.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for extended periods, or for other legitimate operational reasons. See Section 13 for termination details.

4. In-App Purchases and Subscriptions

StoreKit 2 and Apple App Store

All in-app purchases and subscriptions are processed exclusively through Apple's App Store using StoreKit 2. By making a purchase, you agree to Apple's Terms and Conditions. MingleTrivia does not directly process or store payment information.

Subscription Tiers

MingleTrivia offers the following subscription plans:

• Free: Access to a limited selection of trivia packs. No subscription required. No AI credits included.
• MingleTrivia Plus ($4.99/month): Includes all curated trivia packs in the library, plus 10 AI generation credits per month to create custom trivia packs.
• MingleTrivia Pro ($9.99/month): Includes everything in Plus, 25 AI generation credits per month, and access to the Doc-to-Trivia feature (upload PDF or DOCX documents for AI-generated trivia packs).

Subscription prices are displayed in your local currency at the time of purchase. Prices are subject to change with notice as described in Section 14. The applicable price is confirmed at the time of purchase through the App Store.

AI Credit Packs

In addition to subscription credits, AI credit packs may be available for one-time purchase. Credits are non-refundable, non-transferable, and have no cash value. Credits expire as disclosed at the time of purchase. Monthly subscription credits do not roll over to the following month.

Subscription Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. Subscription management and cancellation are handled through your Apple ID account settings or the App Store.

Free Trials

We may offer free trial periods for subscription tiers. If a free trial is offered, the applicable terms (duration, what converts at trial end) will be disclosed at the time of the offer. Unused portions of a free trial period are forfeited upon subscription purchase.

Refund Policy

All refund requests must be submitted directly to Apple through the App Store. MingleTrivia does not process refunds directly. To request a refund, visit reportaproblem.apple.com. Apple's refund policies govern all purchases made through the App Store.

Price Changes

We may change subscription pricing at any time. You will be notified of price changes before your next renewal period, in accordance with Apple's policies. Continued use of your subscription after a price change constitutes acceptance of the new price.

5. User-Generated Content

Content You Create

The Service allows you to create content, including AI-generated trivia packs (by providing prompts or topics) and by uploading documents for Doc-to-Trivia conversion. All content you create or upload is referred to as "User Content."

Ownership

You retain ownership of your User Content. We do not claim ownership over any trivia packs you generate or documents you upload. You represent and warrant that you have all necessary rights to upload and use any documents or source material you submit to the Service.

License Grant

By submitting User Content to MingleTrivia, you grant us a limited, non-exclusive, royalty-free license to process, store, and use your User Content solely for the purpose of providing the Service to you — including generating trivia questions from your documents and delivering AI-generated packs to your account. This license is revocable upon deletion of your content or account.

Document Processing and Deletion

Documents uploaded for Doc-to-Trivia conversion are processed by our AI systems to extract text and generate trivia questions. Uploaded documents are automatically deleted from our servers after processing is complete. We do not use your uploaded documents to train AI models or share them with third parties, except as required by law or as described in our Privacy Policy.

AI-Generated Content

Trivia packs generated by our AI are provided for entertainment and educational purposes. AI-generated content may contain inaccuracies, errors, or outdated information. You are responsible for reviewing AI-generated content before using it in a game session. MingleTrivia makes no warranties regarding the accuracy, completeness, or appropriateness of AI-generated trivia questions.

Content Standards

You agree that any content you create, upload, or generate through the Service will comply with our Acceptable Use Policy in Section 7. We reserve the right to remove User Content that violates these Terms without notice.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose without compensation or attribution to you.

6. Intellectual Property

Our Intellectual Property

MingleTrivia and its licensors own all right, title, and interest in and to the Service, including:

• The MingleTrivia application software, code, algorithms, and architecture
• All curated trivia pack content, questions, and answer sets
• AR card templates, face card designs, and visual presentation formats
• AR experiences, interaction designs, and game mechanics
• The MingleTrivia name, logo, tagline ("Stop Scrolling. Start Mingling."), and all other trademarks, service marks, and trade dress
• All website content, marketing materials, graphics, and copy
• Any improvements, updates, or derivative works of the foregoing

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the MingleTrivia app on iOS devices you own or control, solely for your personal, non-commercial use. This license does not include the right to sublicense, modify, adapt, translate, reverse engineer, decompile, or create derivative works based on the Service.

Restrictions

You may not:

• Copy, distribute, or disclose any part of the Service in any medium
• Use automated tools to access, scrape, or interact with the Service
• Remove or alter any copyright, trademark, or proprietary notices
• Use the MingleTrivia name or logos without our prior written permission
• Use any content from the Service for commercial purposes without our express written consent

Third-Party Technology

The Service incorporates Apple's ARKit, RealityKit, MultipeerConnectivity, StoreKit 2, AVFoundation, and Speech frameworks, which are owned by Apple Inc. and subject to Apple's licensing terms. The Service also uses Firebase, which is owned by Google LLC. Your use of these embedded technologies is subject to the respective third-party terms.

Copyright Infringement

If you believe content on the Service infringes your copyright, please send a notice to legal@mingletrivia.com with: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact information; (4) a statement of good faith belief; and (5) a statement of accuracy under penalty of perjury. We will respond to valid notices in accordance with applicable law.

7. Acceptable Use Policy

Permitted Uses

You may use MingleTrivia for personal, non-commercial social entertainment, educational study groups, classroom activities, corporate team building, and similar lawful purposes. We want the Service to be a positive, inclusive experience for everyone.

Prohibited Content in Custom Packs

When creating AI-generated trivia packs or uploading documents, you must not create or submit content that:

• Contains harassment, hate speech, slurs, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, national origin, or other protected characteristics
• Depicts, promotes, or glorifies violence, self-harm, or illegal activity
• Is sexually explicit, pornographic, or inappropriate for minors
• Contains personal information about third parties without their consent
• Infringes copyrights, trademarks, or other intellectual property rights
• Contains misinformation designed to deceive or mislead players
• Promotes commercial products, services, or organizations in a deceptive manner

Safe AR Usage

MingleTrivia uses AR face tracking that requires you to hold and view your device. You must not:

• Use AR features while operating a motor vehicle, bicycle, or other moving vehicle
• Use AR features while walking in traffic, near roadways, or in any environment where divided attention creates a safety hazard
• Use AR features in ways that obstruct your vision in potentially dangerous settings
• Encourage other players to use AR features in unsafe environments
• Use AR features while operating machinery, near open water, or in other inherently hazardous situations

Peer-to-Peer Network Security

MingleTrivia uses encrypted MultipeerConnectivity for game communication. You must not:

• Attempt to intercept, monitor, or modify network traffic between devices
• Circumvent, disable, or interfere with any security features of the P2P communication layer
• Attempt to inject false data or manipulate game state through network exploitation
• Use packet sniffers, network analyzers, or similar tools to reverse-engineer the wire protocol

Prohibited Conduct Generally

You also must not:

• Use automated bots, scripts, or tools to interact with the Service in any manner
• Attempt to gain unauthorized access to our servers, systems, or data
• Conduct denial-of-service attacks or otherwise disrupt Service availability
• Impersonate any person, entity, or MingleTrivia employee
• Create accounts for the purpose of abusing free trials or promotions
• Use the Service for any commercial purpose without our express written consent
• Violate any applicable local, state, national, or international law or regulation

Enforcement

We may investigate violations of this policy and take appropriate action, including issuing warnings, suspending or terminating accounts, removing content, and referring matters to law enforcement where appropriate. We are not obligated to monitor all content or activity, but we reserve the right to do so.

8. Privacy and Data Use

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Service is described in detail in our Privacy Policy, available at mingletrivia.com/privacy, which is incorporated into these Terms by reference.

Key Privacy Points

• AR Face Tracking: Face tracking is performed entirely on-device using Apple's ARKit. No facial geometry, biometric data, or face scan data is transmitted to our servers or stored by MingleTrivia.
• Peer-to-Peer Data: Game data transmitted between devices via MultipeerConnectivity is encrypted and remains on local devices. Game session data is not stored on our servers.
• Uploaded Documents: Documents uploaded for Doc-to-Trivia are processed and then deleted. See Section 5 for details.
• Analytics: We collect anonymized usage analytics to improve the Service. You may opt out of analytics as described in our Privacy Policy.
• Children's Privacy: We comply with applicable children's privacy laws. Users under 13 require parental consent as described in Section 1.

By using the Service, you consent to the data practices described in our Privacy Policy. If you have questions about our privacy practices, please contact privacy@mingletrivia.com.

9. AR Features Disclaimer

Hardware Requirements

Augmented reality features in MingleTrivia require:

• An iPhone or iPad with Face ID hardware (iPhone X, XS, XR, 11, 12, 13, 14, 15, 16 series, or compatible iPad Pro models)
• iOS 16.0 or later
• ARKit support (automatically detected by the app)

On devices without Face ID, AR face card overlays will be replaced with placeholder views that preserve core gameplay functionality. We do not guarantee a refund of any purchase price solely because your device does not support AR face tracking.

Performance Variability

AR performance, tracking accuracy, and visual quality vary by device model, hardware condition, lighting conditions, and environmental factors. Factors that may degrade AR performance include:

• Low-light or high-glare environments
• Obstructed or partially covered faces (hats, glasses, masks)
• Rapid device movement
• Thermal throttling on older devices during extended play sessions

Performance variability is a known characteristic of AR technology and does not constitute a defect in the Service.

Safe Environment Requirements

You are solely responsible for ensuring that you use AR features in a safe environment. MingleTrivia strongly recommends:

• Playing in a stationary or slow-moving environment with adequate space
• Remaining aware of your surroundings at all times
• Not using AR features while walking, running, or in motion near hazards
• Not using AR features while driving, cycling, or operating any vehicle
• Supervising children who use AR features
• Taking breaks during extended play sessions to avoid eye strain or dizziness

On-Device Processing

All face tracking and AR rendering is performed on-device using Apple's ARKit framework. MingleTrivia does not transmit, store, or process facial geometry data on our servers. Face data never leaves your device.

Assumption of Risk

By using AR features, you acknowledge the inherent risks associated with augmented reality experiences, including reduced awareness of your physical surroundings. You assume all risk associated with your use of AR features and agree to use them only in safe, appropriate environments.

10. Disclaimers

No Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MINGLETRIVIA DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT, INCLUDING AI-GENERATED TRIVIA QUESTIONS
• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE OR ITS SERVERS ARE FREE OF ERRORS

AI-Generated Content

AI-generated trivia content is produced by machine learning models and may contain factual errors, outdated information, offensive content despite our filtering efforts, or culturally insensitive material. MingleTrivia does not warrant the accuracy, appropriateness, or completeness of AI-generated content. You use AI-generated packs at your own risk and should review generated content before use in sensitive contexts.

Third-Party Services

The Service integrates with third-party platforms and services including Apple's App Store, Firebase, and AWS. We disclaim all liability for any acts or omissions of these third parties, and for any content, products, or services provided by third parties. Access to third-party services is subject to their respective terms and policies.

Jurisdictional Note

Some jurisdictions do not allow the exclusion of implied warranties or certain consumer protections. If these laws apply to you, some of the above exclusions may not apply, and you may have additional rights.

11. Limitation of Liability

Exclusion of Consequential Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MINGLETRIVIA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY, PROPERTY DAMAGE, OR PHYSICAL HARM ARISING FROM USE OF AR FEATURES
• COST OF SUBSTITUTE SERVICES
• ANY OTHER INTANGIBLE LOSSES

THE ABOVE EXCLUSIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF MINGLETRIVIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Liability Cap

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MINGLETRIVIA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF:

• (A) ONE HUNDRED DOLLARS (USD $100.00), OR
• (B) THE TOTAL AMOUNT YOU PAID TO MINGLETRIVIA (EXCLUDING AMOUNTS PAID TO APPLE) IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM

Essential Basis of the Bargain

The limitations of liability in this Section reflect a reasonable allocation of risk between you and MingleTrivia. These limitations are an essential element of the basis of the bargain between us. The Service would not be provided without these limitations.

Jurisdictional Note

Some jurisdictions do not allow the limitation of liability for personal injury or death caused by negligence, or for gross negligence, fraud, or intentional misconduct. To the extent such laws apply, the relevant limitations above may not apply to you.

12. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MingleTrivia and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law or regulation
• User Content you create, upload, or generate through the Service, including any claim that your User Content infringes a third party's intellectual property or privacy rights
• Your misuse of the Service, including unsafe use of AR features that causes physical harm or property damage
• Your violation of any third party's rights, including intellectual property rights, privacy rights, or rights of publicity
• Your access to or use of the Service in violation of these Terms
• Any dispute between you and another user of the Service

We reserve the right, at our expense, to assume exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims. You will not settle any claim without our prior written consent.

13. Termination

Termination by MingleTrivia

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

• You materially breach these Terms and fail to cure the breach within 7 days of written notice (or immediately if the breach is incapable of cure)
• You create content that violates our Acceptable Use Policy, particularly content involving minors or incitement to violence
• Your account is used for fraudulent activity, including abuse of trials or promotions
• We are required to do so by applicable law or a valid order from a governmental authority
• Continued provision of the Service to you would expose MingleTrivia to legal, regulatory, or reputational risk

Termination by You

You may terminate your use of the Service at any time by:

• Deleting the MingleTrivia app from your device
• Cancelling your subscription through your Apple ID account settings
• Contacting us at support@mingletrivia.com to request account deletion when account features become available

Effect of Termination

Upon termination:

• Your license to use the Service is immediately revoked
• Your access to purchased content, subscription benefits, and AI credits will cease
• We are not obligated to provide refunds for unused subscription time or credits, except as required by applicable law or Apple's refund policies
• Provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 10, 11, 12, 15, and 17

Termination does not limit any other rights or remedies we may have at law or in equity.

14. Modifications to Terms

Our Right to Modify

We reserve the right to modify these Terms at any time. If we make changes that we consider material, we will:

• Provide at least 14 days' advance notice before the changes take effect
• Post a notice on our website at mingletrivia.com
• Send an email notification to waitlist members (and registered users, when applicable)
• Display an in-app notification when you next open MingleTrivia

What Constitutes Material Changes

We consider changes to be material if they: significantly alter your rights or obligations; change the scope of data we collect or how we use it; add new fees or change pricing structures; alter dispute resolution procedures; or otherwise significantly affect your use of the Service.

Continued Use

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel any subscriptions before the changes take effect.

Non-Material Changes

For non-material changes (such as clarifications, typographical corrections, or updates to contact information), we may update the Terms without advance notice. The "Last Updated" date at the top of this page will always reflect when the Terms were most recently changed.

15. Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal Resolution

Before initiating formal dispute resolution proceedings, you and MingleTrivia agree to attempt to resolve any dispute informally. To initiate informal resolution:

• You must send a written description of your dispute to legal@mingletrivia.com
• Include: your name, a detailed description of the dispute, and the resolution you seek
• We will respond within 30 days
• If the dispute is not resolved within 30 days of your notice, either party may proceed to arbitration as described below

Binding Arbitration

Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service — including questions of arbitrability — will be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in English. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND MINGLETRIVIA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR MASS ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Small Claims Exception

Either party may bring an individual action in small claims court if the claim qualifies, without first engaging in the informal dispute resolution process above.

Arbitration Costs

Payment of all filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules. If you prevail in arbitration on the merits of your claim, you may be entitled to an award of attorneys' fees and expenses. MingleTrivia will not seek attorneys' fees in arbitration unless your claim is found to be frivolous.

Venue for Non-Arbitrable Claims

For any matters that are not subject to arbitration (such as injunctive relief to prevent unauthorized use of intellectual property), the parties consent to exclusive jurisdiction and venue in the state and federal courts located in San Francisco County, California.

Opt-Out

You may opt out of the binding arbitration and class action waiver provisions of this Section within 30 days of first agreeing to these Terms by sending written notice to legal@mingletrivia.com with the subject line "Arbitration Opt-Out" and including your name and the email address associated with your account. Opting out does not affect any other provision of these Terms.

16. Accessibility

Our Commitment

MingleTrivia is committed to making the Service accessible to people with disabilities. We work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA for our website, and with Apple's accessibility standards for the iOS app, including VoiceOver, Dynamic Type, and Reduce Motion support.

Current Accessibility Features

• VoiceOver support for screen reader users on iOS
• Dynamic Type support for adjustable text sizes
• Reduce Motion support for users sensitive to animation
• Accessibility identifiers on interactive elements for assistive technology
• High contrast design elements throughout the UI

Known Limitations

AR face tracking and face card display features are inherently visual and may have limited accessibility for users with certain visual impairments. We are actively exploring audio and haptic feedback alternatives. Non-AR gameplay modes remain fully accessible.

Third-Party Accessibility

Some areas of the Service rely on third-party platforms (Apple App Store, Firebase). We cannot guarantee the accessibility of third-party interfaces and encourage you to contact those providers directly with accessibility concerns about their platforms.

17. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms disclosed at the time of a specific feature or purchase, constitute the entire agreement between you and MingleTrivia with respect to the Service, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter hereof.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed from these Terms. The remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. A waiver of any provision in a particular instance does not constitute a waiver of the same provision in other instances or of any other provision.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. MingleTrivia may freely assign or transfer these Terms in connection with a merger, acquisition, sale of assets, or operation of law. These Terms will be binding on and inure to the benefit of the parties and their respective permitted successors and assigns.

Force Majeure

We will not be liable for any failure or delay in performance to the extent caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, government action, labor disputes, internet outages, power failures, or failures of third-party service providers.

Notices to MingleTrivia under these Terms should be sent to legal@mingletrivia.com or by mail to MingleTrivia, [Address]. We will send notices to you at the email address associated with your account, or by in-app notification. Notices are effective when sent by email (receipt confirmation not required) or when displayed in-app.

Headings

Section headings in these Terms are for convenience only and have no legal or contractual effect.

Language

These Terms are written in English. If these Terms are translated into another language, the English version will control in case of any conflict or inconsistency between the English version and any translation.

No Third-Party Beneficiaries

These Terms do not confer any rights or remedies on any third party. The only parties to these Terms are you and MingleTrivia.

Relationship of Parties

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and MingleTrivia. You are an independent user of the Service.
